Licensing Act 2003 – Consultation on review of Licensing Policy Statement
Under the terms of the Licensing Act 2003, local authorities being the licensing authorities under the Act are required to review their licensing policy statements at least every 3 years. The original licensing policy came into effect in January 2005 and was reviewed by the Licensing Committee in December 2007. The policy must now be fully reviewed, and re-published by no later than 7 January 2011. We would be grateful if you would return any comments you may have as soon as possible and preferably by 8th October 2010.
This consultation is being carried out in accordance with the Licensing Act 2003 and, where appropriate, with the Cabinet Office Code of Practice on Consultation. The Act sets out certain ‘licensable activities’ and it is an offence to carry on licensable activities except under and in accordance with an authorisation under the Act.
Licensable activities are:-
- Retail sale of alcohol
- Supply of alcohol by a club to members and their guests
- Regulated entertainment which includes:-
- Live and recorded music
- Dancing
- Provision of facilities for making music or dancing
- Performances of plays
- Exhibition of films
- Indoor sporting events
- Boxing / wrestling
- Provision of hot food / hot drink between the hours of 11pm – 5am the following morning
An authorisation will usually be in the form of a Premises Licence, or Club Premises Certificate, although in certain (limited) cases a Temporary Event Notice may be used.
There are a number of exemptions to the licensing regime which are provided for in the Act.
The Licensing Objectives
The Act requires that the licensing authority conducts its statutory responsibilities under the Act with a view to promoting the licensing objectives which are:-
- Prevention of Crime & Disorder
- Public safety
- Prevention of public nuisance
- Protection of children from harm
Applicants for licences are expected to consider the licensing objectives when applying for a licence and set out the measures which will be taken to promote the objectives. The Act sets out the procedures to be followed in relation to the various types of licence, and provides for a system of reviews of licences where there are problems. In all cases, objections against licence applications or requests for review, must focus on the impact on the licensing objectives.
The City Council’s Licensing Committee will then give due consideration to all comments received at the Licensing Committee in December. We would therefore be grateful if you would return any comments you may have as soon as possible and preferably by 2nd November 2007.

The Licensing Policy Statement will be finalised after this period of consultation and will then be adopted at a full meeting of the City Council.
