Parking Enforcement Protocol

Parking Offences were decriminalised under the Road Traffic Act 1991. This enables local authorities to establish Special Parking Areas (SPAs). Within these areas, the local authority (or their representatives) can charge for and enforce all non-endorsable parking restrictions.

The Traffic Management Act 2004

Part 6 of The Traffic Management Act 2004 (TMA) (Parking Regulations) comes into force on Monday 31 March 2008. The TMA 2004 replaces part II of the Road Traffic Act 1991and sections of the London Local Authorities Act 1996 and the London Local Authorities and Transport for London Act 2003 to provide a single framework in England for the civil enforcement of parking, bus lanes, some moving traffic offences and the London lorry ban. Under the TMA 2004, Decriminalised parking will become known as Civil Parking Enforcement (CPE) and Parking Attendants will become Civil Enforcement Officers (CEOs). Regulations that have been made and laid in parliament and the Statutory guidance reflects them. These documents set out what actions Local Authorities must or must not take.

Differential Charging

On 31st March 2008 the Traffic Management Act 2004 came into force. Differential parking penalties also started on 31st March 2008. There has been an increase in the penalty charge for some contraventions and a decrease in others.

Differential parking penalties are compulsory, not optional or adoptive and each Local Authority implemented the changes on the same day.

The higher penalty charge applies to contraventions associated with prohibited parking. The contraventions to which the lower level applies are defined where there is ‘permitted parking for that class of vehicle'.

Civil enforcement of parking cancellation policy

PCN appeals are considered on their individual circumstances, and the council, as the Enforcement Authority, may re-offer the fourteen-day discount period for a challenge received within fourteen days beginning with the date on which the PCN was served, should the challenge be rejected. This information is for guidance only and each Penalty Charge Notice (PCN) case will be considered on its individual set of circumstances.

The City Council is the leading provider of parking services in Worcester City. We have fourteen car parks with over 2500 spaces, and three 'on street' controlled parking zones, for people living in, working in or just visiting the City of Worcester. We are also responsible for the enforcement of 'off street' parking regulations. These are regulations that apply to parking restrictions placed on the highway.

The majority of our car parks have attained 'Safer Parking' status. This is a prestigious achievement awarded by the British Parking Association and Association of Chief Police Officers under the Safer Parking Accreditation Scheme. The government would like to see all car parks achieve this standard.

Park Mark - Safer Parking. It is the job of Worcester City Council to keep Worcester ‘on the move' for the benefit of all road users, avoiding problems caused by irresponsible or inconsiderate parking.

You may park your motor vehicle on the road providing it is safe to do so and there are no Traffic Regulation Orders in place which prohibit or restrict you from doing so. Where we find motor vehicles contravening the traffic regulations we may apply our enforcement policy.

Our parking services staff are employed to administer and enforce the Traffic Regulation Orders fairly and equitably within our car parks and on the highway throughout the city where parking restrictions exist. Our parking service operates 7 days a week, 52 weeks a year.

We believe that effective parking enforcement benefits public transport users, pedestrians, motorcyclists, cyclists, responsible drivers and other road users.

The Parking Service team maintain pay and display ticket machines within Council owned car parks as well as signs and lines. Together with our partner agency, Worcestershire County Council, we are responsible for the infrastructure of 'on' and 'off' street parking to make sure parking bays and spaces are always available and safe to use.

The team also aims to handle all enquiries in a courteous and helpful manner and respond to all written representations about penalty charge notices.

We will expect the users of our car parks:

To pay the appropriate charge. (Charges apply 24 hours a day, including Sundays and Bank holidays)
To properly display a valid pay and display ticket so it can be easily seen and read as to date, time and amount paid
To park correctly in a parking bay
Use only one parking space. (Do not park on the white lines or allow your vehicle to overhang into the adjoining bay)
To ensure that any motor vehicles using our car parks are properly insured to the minimum requirements of the Road Traffic Act
To ensure that any motor vehicle using our car parks displays a valid vehicle excise disk (VED)
To ensure that any motor vehicles using our car parks do not cause an obstruction to other road users, including pedestrians
Have consideration for other road and car park users
Treat our Civil Enforcement Officers in a civil and courteous manner

Parking only in marked bays
Not losing your ticket
Reporting any incidents including accidents where damage has occurred to our property
Having enough cash to cover your parking fee
Putting your litter in the bins provided
Making sure your motor vehicle is not too high for the car park entrance

Where you can find us

We have fourteen convenient car parks in Worcester City offering parking services to business users, residents and visitors. Thirteen of those car parks allow users of vehicles that meet the below criteria to park, providing the unladen weight of the vehicles does not exceed 2750kgs.

Croft Road car park in addition provides facilities for vehicles larger than the below, to park,up to a maximum gross weight of 42 tonnes.

Trailers may also be parked in Croft Road Car Park. A trailer is any trailer towed by a motor vehicle.

Parking restrictions in force in Worcester City

Parking on a single yellow line

Generally, you cannot park on a single yellow line between 8 am and 6 pm, Monday to Saturday. You should always check street signs or the controlled parking zone signs for confirmation of the regulations, as the hours when single yellow lines operate vary from location to location.

Parking on a double yellow line

This is not permitted at any time of the day or night, weekdays or weekends. Double yellow lines denote an area where it can be dangerous to park, or where leaving your vehicle can be a hazard to other road users. Double yellow lines are placed on the highway to improve road safety. Those who park on double yellow lines will receive a Penalty Charge Notice (PCN).

Parking in a loading bay

These areas are for the specific use of vehicles that wish to load and unload. Some bays are for the specific use of commercial vehicles only, although you should always check street signs for confirmation of regulations. Those who simply park in a loading bay without loading or unloading will receive a Penalty Charge Notice (PCN).

Parking in a Residents Parking Zone

These areas are for the use of residents who must display a valid resident's permit or their visitors who must display a valid resident's permit.

Parking in a residents parking zone without the proper authority will attract a Penalty Charge Notice (PCN).

Parking in Council-owned car parks

We encourage people living in, working in, or just visiting the City of Worcester to use our car parks. Our car parks are safe and clean and are strategically located around the City to be convenient to all the facilities the City has to offer.

Motorcycles may park free in the designated areas of our car parks. With the exception of Croft Road car park all our car parks have height and width restrictions in place. Motor vehicles may only be parked within the designated car parking bays.

How to avoid receiving a Penalty Charge Notice (PCN)

Check the times when parking is allowed
Park fully within the markings of the bay
Check that the bay is not suspended – especially if you park here frequently
Do not leave your vehicle to go and get change for the pay and display machine
Check that your pay and display ticket shows the expiry time before leaving your vehicle
Do not leave more than one ticket on display – always remove expired ones
Check that your ticket, permit or badge is properly displayed before you leave your vehicle
Do not come back to your vehicle and insert additional coins into the pay and display machine if buying extra time is not permitted
Before parking on a single yellow line, check the time plate allows you to do this
Do not park on double yellow lines anytime day or night
Do not park in taxi bays or taxi ranks
Do not park in bays designated for use by disabled users without displaying a blue badge
Do not park in a loading bay without loading or unloading
Do not park in a dual use bay during restricted times
Do not park in residents parking bays without displaying a residents parking permit

Worcester City Council understands that there may be occasions where a vehicle will need to stop or park at locations they would normally not be permitted, due to the Traffic Regulation Order. In some circumstances, a Parking Dispensation may be issued, if certain criteria are satisfied.

For instance, a builders lorry collecting debris, a cement mixer delivering cement or a glazier fitting windows, in each case, it would not be unreasonable to expect the vehicle to remain at that location while work is completed.

Dispensations will not be issued simply because it is convenient for the driver to park there.

The question that must always be satisfied will be, 'Is the vehicle actually required there at the location, all the time? Can it be moved?'

Dispensations will not be given to park in bus stops, bus lanes, taxi ranks, or disabled bays.

If there is no other alternative, we would require at least five working days’ notice, to consider the application and contact the relevant council departments to request special dispensations.

Where residential parking schemes have been implemented, residents may choose to use Visitor Parking Sessions as an alternative to the dispensation service. You can read more about Visitor Parking Sessions here.

Parking Dispensation – One or Seven Days.

Worcester City Council no longer issues physical dispensations. Instead, like many other parking authorities and providers, we have moved to a 'Virtual' system.

If you need to park at a restricted or prohibited location for you may apply for a Parking Dispensation online via Mi Permit

This will enable you to park for up to but not exceeding the date. It will expire at midnight on the day.

One Day Dispensation is a non-refundable administration fee of £10.00 per vehicle.

For the Seven Day dispensation will be a non-refundable administration fee of £55 per vehicle on application for the first initial seven days. After the first initial seven days, the charge will be £10.00 per day. Once purchased and authorised via Mi Permit portal; the Civil Enforcement Officers will not issue a Penalty Charge Notice to your vehicle at the named location.

Please Note: the issue of a Dispensation does not grant an absolute authority to park on the Highway in contravention of the prevailing Traffic Regulation Orders in Force at that time. It simply means that Worcester City Council will note the reason for the vehicle being at the location and Civil Enforcement Officers will not issue a Penalty Charge Notice to the vehicle that would in normal circumstances require the issue of such a notice. The Police may direct you to move the vehicle at any time.

Apply for Seven Day Parking Dispensation

Over-night Parking Permits

In addition to the longer stay Season Parking Permits, Worcester City Council also provide an Over-night permit that allows parking between the hours of 18:00. and 09:00. without the need to purchase a Pay & Display Ticket.

Overnight Parking Permits are now in the virtual form and we no longer supply a paper permit to place in your car. Instead you can manage your own account via the MiPermit Portal. This type of permit is available in the following car parks.

Season Parking Tickets are available for eleven of its fifteen City Centre car parks. Drivers will be able to purchase Season Parking Tickers allowing access to car parks within two distinct Zones, depending on the price paid.

All prices are inclusive of VAT.

The Season Parking Ticket allows the use of one car parking space* within any car park within the selected zone. Drivers will be free to park at different locations in the City simply by clearly displaying the correct Zone Season Parking Ticket. No longer will drivers be restricted to just one car park, Worcester City Council recognises that people need flexibility in planning their parking activities.

The display of the Season Parking Ticket also allows the driver to come and go in and out of the car park as often as necessary during the 24-hour period, drivers are not restricted to parking and remaining there all day. Provided a Season Parking Ticket is displayed, drivers are free to come and go as they choose (Provided a space is available)

Please Note:

The vehicle must be correctly parked within the standard bays and not in specifically designated spaces, such as Motorcycle bays, disabled persons blue badge bays or bays reserved for parents & toddlers.
Applications for Season Parking Tickets should be made two working days in advance of the date on which you wish the Season Parking Ticket to commence.
If the Season Parking Ticket is not clearly displayed in the front windscreen of your vehicle when parked, a Penalty Charge Notice may be issued.
In addition, a Penalty Charge Notice may be issued if the vehicle continues to park after the Season Parking Ticket has expired.

* The purchase of a Season Parking Ticket does not guarantee a space being available at all times for the benefit of the Season Ticket holder, parking is subject to availability on the day.

Virtual Season Tickets

Worcester City Council no longer issue physical Season Parking Permits for our car parks in the Amber & Green zones. Instead, like many other parking authorities and providers, we have moved to a 'Virtual' system. This means once you have applied for and made your payment, you will no longer receive a pass to put in the windscreen of your car.

Instead, you will apply via the 'MiPermit' system that will process your application, take your payment and create your own unique account in which you can manage which car you are using on the day, change vehicles or extend the period of operation for instance.

All the existing terms and conditions remain the same, the only difference is that you will not have anything to place in your car. The patrolling Civil Enforcement Officers have instant access to the database that shows all current permits in operation and they simply tap in your registration number on their handheld device to check you have a current Season Permit when they see a car with no Pay & Display ticket in the windscreen.

This is very similar to the RingGo Pay by Telephone system and the way in which the DVLA administer your virtual Vehicle Excise Licence.
