Worcester City Council Off-Street Parking Places Variation Order 2023

Worcester City Council (hereinafter referred to as “the Council”) in exercise of its powers under Sections 32, 35(1) and (3) and Part IV of Schedule 9 of the Road Traffic Regulation Act 1984 (as amended) (hereinafter referred to as “the Act”) and under the Traffic Management Act 2004 (as amended) and of all other enabling powers, with the consent of the Worcestershire County Council in accordance with Section 39(3) of the Act and after consulting with the Chief Officer of Police in accordance with paragraph 20 of Schedule 9 to the Act, hereby make the following Order:

  1. This Order shall come into operation on the 1 April 2023 and may be cited as “The Worcester City Council (Off Street Parking Places) Variation Order 2023”
  2. The Worcester City Council (Off Street Parking Places) Order 2023 (“the Original Order”) is hereby varied by the following:
    1. The following definition shall be added after the Electric Vehicle definition:
      EV Residents’ Permit” means a Season Ticket issued to those residents that meet the following criteria:
      1. The resident uses an Electric Vehicle or PHEV
      2. The resident lives within 1000m of a Car Park which contains Electric Vehicle Charging Points

        And permitting such residents to park their Electric Vehicle or PHEV in Electric Vehicle Parking Bays whilst actively charging (at the start of the parking session) between 18:00 hours and 08:00 hours whilst using Fast Chargers only.’

    2. At Article 6.2.1 the following sentence shall be deleted on the second line ‘a maximum stay of 4 hours’ and shall be replaced with ‘a maximum stay of 10 hours.
    3. At Article 6.2.2 the following sentence shall be deleted on the second line ‘a maximum stay of 60 minutes’ and shall be replaced with ‘a maximum stay of 2 hours.
    4. At the end of Article 21.3 a new Article 21.4 shall be inserted as follows:
      For the avoidance of doubt, EV Resident’s Seasons Tickets shall only entitle the holder to park in Electric Vehicle Charging Bays and not in those marked as restricted to resident’s parking (unless such are also Electric Vehicle Charging Bays)’
    5. At Article 22.1.1 on the first line ‘one hour’ shall be deleted and replaced with ‘two hours’
    6. At Article 22.1.2 on the first line ’60 minutes’ shall be deleted and replaced with ‘two hours’.
    7. After Article 22.6 a new Article 22.7 shall be inserted as follows:

      22.7 For those persons with an EV Resident’s Permit they may park their Electric Vehicle/PHEV in an Electric vehicle Parking Bay whilst using Fast Chargers only and provided they are actively charging at the start of the session. They must still pay the relevant electricity tariff but shall not be subject to the restrictions in 22.2.1 in relation to such parking between 18:00 and 08:00.’

    8. the deletion from Part 2 of the Schedule to the Original Order within the King Street row of the table the details under the column ‘number of spaces’ and the insertion of: ‘98 + 3 dis + 8 EV*’
    9. The deletion of the paragraph starting ‘*St Martins Gate Car Park provides…’ and replacing it with:

      ‘*St Martins Gate Car Park provides both Rapid and Fast Charge EV Parking Bays. Rapid charge parking bays will provide a maximum 2 hour stay at no charge. Fast charge bays will provide a maximum 10 hour stay in line with the pricing structure above.

      Tallow Hill and King Street Car Parks provide only Fast Chargers.’

    10. the deletion from Part 2 of the Schedule to the Original Order within the Tallow Hill row of the table the details under the column ‘number of spaces’  and the insertion of: 95 + 3 dis + 12 EV*
    11. The insertion in Part 2 of the Schedule in the Convenient fee row of ‘pay by phone’ after the words “(no pay and display) and the…”.
    12. The insertion of a paragraph at the end of Part 3 of The Schedule as follows:

      ‘EV Resident’s Permits are also available at car parks with Electric Vehicle Parking Bays with permitted use 7 days per week for free parking between the hours of 18:00 and 08:00 whilst actively charging (at start of session) using Fast Chargers only and subject to paying the appropriate electricity tariff.’
  1. In all other respects the Original Order shall remain in full force and effect.
